Terms and Conditions

Article 1 – Definitions

• Entrepreneur: KoolFriends Toys B.V., established in Amsterdam, registered with the Chamber of Commerce (KvK).
• Consumer: the natural person who does not act in the exercise of a profession or business and enters into an agreement with the entrepreneur.
• Agreement: any purchase and/or delivery agreement between the consumer and the entrepreneur.
• Product: all goods offered by KoolFriends Toys B.V., including toys (FridgeBuddies, etc.).

Article 2 – Applicability

These terms and conditions apply to every offer made by the entrepreneur and to every agreement between the entrepreneur and the consumer.

Article 3 – Offer

• The offer contains a complete and accurate description of the products offered.
• Errors or obvious mistakes in the offer do not bind the entrepreneur.

Article 4 – Agreement

• The agreement is concluded at the moment the consumer accepts the offer and complies with the conditions set therein.
• After acceptance, the entrepreneur will promptly confirm receipt of the order electronically.

Article 5 – Right of Withdrawal

• The consumer may cancel the agreement within 30 days after receipt without stating any reason (see Return Policy).
• Return shipping costs are borne by the consumer, unless the product is defective or delivered incorrectly.

Article 6 – Obligations of the Consumer

• The consumer shall handle the product with due care during the withdrawal period.
• Products that are clearly used or damaged may be refused or only partially refunded.

Article 7 – Prices and Payment

• All prices include VAT, unless stated otherwise.
• Payment must be made using the payment methods offered in the webshop.
• In the event of late payment, the entrepreneur reserves the right to terminate the agreement.

Article 8 – Delivery

• The entrepreneur will exercise the utmost care in fulfilling orders.
• Delivery will take place at the address provided by the consumer.
• Exceeding the delivery period entitles the consumer to dissolve the agreement if delivery does not take place within a reasonable period thereafter.

Article 9 – Warranty and Conformity

• The entrepreneur guarantees that the products comply with the agreement and statutory conformity requirements.
• In the event of defects or incorrectly delivered products, the consumer must report this within a reasonable period.
• This warranty is without prejudice to the consumer’s statutory rights.

Article 10 – Liability

• The entrepreneur is not liable for indirect damage or consequential loss.
• Liability is limited to the value of the delivered product, unless there is intent or gross negligence.

Article 11 – Complaints Procedure

• The consumer must submit complaints fully and clearly described within 14 days after discovering the defect.
• The entrepreneur will respond to complaints as soon as possible, but no later than within 14 days.

Article 12 – Disputes

• Agreements between the entrepreneur and the consumer are governed exclusively by Dutch law.
• Disputes may be submitted to the competent court in Amsterdam, unless mandatory law provides otherwise.
